This Notice, and the Jurisdiction-specific Notices, apply to any natural person that we process personal data about where such personal data has been collected by us (or our service providers):

  • on or through our website;
  • through offline and online communications (including emails);
  • when you visit our offices (including via our CCTV system);
  • about representatives of our vendors, business partners and portfolio companies; and
  • when you apply for a job with us.

This Notice, and the Jurisdiction-specific Notices, do not apply to any processing of personal data by or on behalf of Montagu that is covered by a more specific privacy notice (including, but not limited to, our employee and contractor privacy notices, our subscription agreement investor privacy notices and our Montagu Connect privacy notice).

In addition to reading this Notice, if you are:

What personal data may we collect about you?

Depending on the nature of our relationship or interactions with you, we (or our service providers) may collect some or all of the following personal data about you for one or more purposes set out in this Notice:

  • Your basic information: Name, prefix/title, gender, age and/or date of birth.
  • Contact information: Email address, physical address and/or phone number.
  • Information we obtain by automated means: Information about your computer or device, software and IP address.
  • Information obtained through communications with us: Information obtained through telephone calls (which may be recorded for regulatory purposes), video communications and other verbal communications, as well as written correspondence.
  • Images: Video footage or static images recorded by our CCTV cameras which are located at entrance and exit points to our offices, and/or photographs of you that are taken at our events (e.g., photographs of keynote speakers).
  • CV information: Education history, employment history, professional designations and other information about your qualifications.
  • Other information: Information obtained through publicly available external websites (e.g., LinkedIn and other social media sites).

Although we collect and use data for the purposes of diversity and inclusion monitoring, or to meet our ESG commitments or objectives, we only gather and use such data on an anonymised basis.

We may use your personal data for the following purposes:

Note that we may process your personal data on more than one legal basis depending on the specific purpose for which we are using your personal data.

No solely automated decision-making, including profiling, is used when processing your personal data.

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and explain the legal basis which allows us to do so.

Information for marketing purposes

We use your information to identify products, services and events that we think may be of interest to you.  Where you are not using a corporate address, we will only send you marketing messages where you have consented to such contact, or in the case of products and services, where these are similar to those that we have already provided to you.

You have the right to ask us not to not send you marketing messages by post, telephone or e-mail or any combination of these at any time. You can also let us know at any time that you wish to change your mind and to start receiving such messages.

You can do this:

  • by replying directly to the marketing message;
  • in case you wish to withdraw from all marketing communications, you can also unsubscribe from all marketing by clicking the appropriate link in any email you receive; or
  • at any time by contacting us (see the ‘Contact Us’ section below).

With whom may we share your personal data?

We may share your personal data with the following external third parties as necessary to fulfil the purposes set out in this Notice:

  • our group companies and affiliates;
  • our service providers, including those providing IT (including communications software), web-design, technical, HR and recruitment, referencing, marketing and analytical services (including, providers of third party cookies and similar technologies) and professional advisers;
  • our agents; and
  • regulators, law enforcement and other government bodies.

We may also share aggregated or anonymised data (that does not contain your personal data but which may derive from it) with other third parties.

Our website contains links to other websites which are not hosted or operated by us. These websites may use automated means to collect information regarding your use of the websites. This information is subject to the privacy policies or notices of the provider’s website.

We reserve the right to disclose your personal data as required by law, or when we believe disclosure is necessary to comply with a judicial proceeding, court order, request from a regulator, or any other legal or investigatory process we may be involved in.

Protecting your personal data

We will use a variety of security measures and technologies to help protect your personal data from unauthorised access, use, disclosure, alteration or destruction, consistent with applicable privacy and data security laws. For example, when we transfer personal data to a third-party service provider, that provider will be carefully selected in accordance with our policies and procedures and will be required to enter into a contract which commits the provider to use appropriate safeguards in relation to the handling of your personal data. These safeguards include maintaining confidentiality of your personal data and implementing appropriate technical and organisational security measures.

Although we exercise adequate care and security, there remains a risk that personal data transmitted over the internet and stored digitally may be intercepted or accessed by an unauthorised third party. As such, any transmission of personal data by you to or through our website is at your sole risk.

How long will we keep your personal data?

We actively review the personal data we hold on a periodic basis and delete it securely, or in some cases anonymise it, when there is no longer a legal or business need for it to be retained. We will keep your personal data for as long as we need it for the purpose it is being processed for (or a compatible purpose). For example, where you provide your details in relation to a contract with you, we will keep such personal data for as long as necessary to provide you with our services and after that, we will keep the information for a period which enables us to handle or respond to any complaints, queries or concerns. We may also retain your personal data so that we can continue to improve your experience with us and to ensure that you receive any information or marketing materials which would benefit you. We will also keep your personal data where we need to do so in connection with regulatory requirements, legal action or an investigation involving Montagu and its affiliates.

Your rights

Under certain circumstances, by law you have the right to:

  • ask Montagu about the processing of your personal data, including to be provided with a copy of your personal data;
  • request the correction and/or deletion of your personal data;
    request the restriction of the processing of your personal data, or object to that processing;
  • request receipt or transmission to another organisation, in a machine readable form, of the personal data that you have provided to Montagu; and
  • complain to your local supervisory authority if your privacy rights are violated, or if you have suffered as a result of unlawful processing of your personal data.

Cookies and similar technologies

We may use third-party cookies or similar technologies on this website, including Google Analytics. The service providers of these technologies help us analyse how you and other visitors use the website, including by estimating our audience size and usage patterns and storing information about your preferences. This information allows us to customise the website according to your individual interests and recognizes when you return to the website, or may be stored by us for administrative purposes or to gather statistical data. When we obtain personal data about you using cookies, we will always ask you if we can do this first. GDPR Privacy Notice

This GDPR Privacy Notice supplements the Notice with respect to additional information as required by applicable EU and UK data protection laws, including Regulation (EU) 2016/679 (the “EU GDPR”), the UK equivalent of the EU GDPR (the “UK GDPR”) and the Data Protection Act 2018 (the “EU and UK Privacy Laws”). For the purposes of EU and UK Privacy Laws, Montagu acts as a controller of the personal data it collects in the ways described above (e.g., when you visit the website, etc.).

Is there any additional personal data that we may collect about you?

We do not collect any information about criminal convictions and offences. In general, we also do not collect any “special category” personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data), although there may be limited circumstances where we need to collect this type of personal data, or it is collected incidentally (e.g., via our use of CCTV systems). 

Are there any other legal bases we rely upon?

We rely on various legal bases under the EU and UK Privacy laws in order to process your personal data, as we have set forth in the Notice above in the section ‘How we use your personal data and our legal basis’.  The section also sets out the specific purposes for which we use your personal data, which in general is to operate our business, conduct business with you and perform essential or legitimate business operations.

If we require your personal data due to a legal requirement or obligation or in order to perform a contract with you, we will make you aware of this at the time we collect your personal data, and the possible consequences of failure to provide this personal data (e.g., inability to conduct business with you and cancelling an existing arrangement, receiving an unoptimized user experience when visiting our website, etc.).

Transfers to third countries

Once we have received your personal data, we may store it in hard copy paper form and/or electronically. Your personal data may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”) which may not always have data protection laws providing equivalent protection.

In such case, we will take steps to ensure that your information is protected by appropriate organisational and security measures, and that any such transfers are done using specific legally-approved safeguards.

Your rights

Under certain circumstances, by law you have the right to access personal data we maintain about you, and there are several ways you can control the way in which and what personal data we process about you. To exercise these rights, please let us know by using the details in the ‘Contact Us’ section below.

  • Access: You have the right to ask Montagu about the processing of your personal data, including to be provided with a copy of your personal data. Note that you will not have to pay a fee to access your personal data (or to exercise any of the other rights).  In some cases, we may charge a reasonable fee if your request for access is clearly unfounded or excessive, or if you request multiple copies of the information. Alternatively, we may refuse to comply with the request in such circumstances.
  • Correction/Deletion: You have the right to request the correction and/or deletion of your personal data if you think the personal data is inaccurate or needs to be updated, or if you believe we shouldn’t be processing your personal data anymore. Please note it may not be always possible to fulfil requests for deletion due to legal obligations.
  • Restrictions on use: You may request a restriction of the processing (other than storing it) of your personal data in certain cases, such as: i) if you contest the accuracy of it (until the accuracy is verified); ii) you believe the processing is against the law; iii) you believe that we no longer need your personal data for the purposes for which it was collected, but you still need your personal data to establish or defend a legal claim; or iv) you object to the processing, and we are verifying whether our legitimate grounds to process your personal data, override your own rights.
  • Object: You have the right to object to processing, including i) for direct marketing; ii) for research or statistical purposes; or iii) where processing is based on legitimate interests.
  • Portability: If you prefer to transfer your personal data on the legal ground of contractual necessity to another organisation (pending certain conditions be satisfied), you can request receipt or transmission of such data in a machine readable form.
  • Withdrawal of consent: If you previously gave us your consent (e.g., affirmative opt-in) to allow us to process your personal data for a particular purpose not specified in the Notice or this GDPR Privacy Notice, but you no longer wish to consent to such processing, you can contact us to let us know that you withdraw your consent by using the details in the ‘Contact us’ section below.
  • Lodge a complaint: You have a right to lodge a complaint to your local supervisory authority (as discussed below) if your privacy rights are violated, or if you have suffered as a result of unlawful processing of your personal data.

If you would like more information about your rights or have any concerns about Montagu’s processing of your personal data, please let us know by getting in touch with us using the details in the ‘Contact us’ section below. We will respond to your request within one month of receipt of your request. In some cases we may not be able to fulfil your request to exercise the right before this date, and may need to request more time. Where we cannot provide a full response to you for any reason, we will let you know about this in our initial reply to your request.

The various rights are not absolute and each is subject to certain exceptions or qualifications. Where you are given the option to share your personal data with us, you can always choose not to do so. If you object to the processing of your personal data, we will respect that choice unless the processing of your personal data is based on our overriding legitimate grounds. If you object and we decide to stop processing your personal data, this could mean that we are unable to perform the actions necessary to achieve the purposes of processing described in the ‘How we use your personal data and our legal basis’ section above. California Privacy Notice

This California Privacy Notice supplements the Notice with respect to specific rights granted under the California Consumer Privacy Act of 2018, as amended (the “CCPA) to natural person California residents and provides information regarding how such California residents can exercise their rights under the CCPA.  This supplement is only relevant to you if you are a resident of California as determined in accordance with the CCPA.  Information required to be disclosed to California residents under the CCPA regarding the collection of their personal data that is not set forth in this CCPA supplement is otherwise set forth in the Notice.  To the extent there is any conflict with the privacy requirements under the Gramm-Leach-Bliley Act and/or Regulation S-P (“GLB Rights”), GLB Rights shall apply.

What personal data may we collect about you?

The types of personal data we collect about you depends on the nature of your interaction with us. Please see the section of this notice, ‘Who does this Notice and the Jurisdiction-specific Notices apply to’ for details regarding the data collection scenarios covered by the Notice as supplemented by this California Privacy Notice. The categories of personal data we have collected from individuals over the last twelve (12) months through these interactions include the following:

We do not knowingly collect or solicit personal data from anyone under the age of 18.

We do not collect or use sensitive personal data other than:

  • To perform services, or provide goods, as would reasonably be expected by an average consumer who requests those goods or services;
  • As reasonably necessary and proportionate to detect security incidents that compromise the availability, authenticity, integrity, and confidentiality of stored or transmitted personal data;
  • As reasonably necessary and proportionate to resist malicious, deceptive, fraudulent, or illegal actions directed at us and to prosecute those responsible for such actions;
  • For short-term, transient use (but not in a manner that discloses such information to another third party or is used to build a profile of you or otherwise alter your experience outside of your current interaction with us);
  • To perform services on behalf of our business;
  • To verify or maintain the quality or safety of a service or to improve, upgrade, or enhance such service or device; and
  • To collect or process sensitive personal data where such collection or processing is not for the purpose of inferring characteristics about a consumer.

Some internet browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference (the “DNT Signal”) to websites you visit indicating that you do not wish to be tracked. At this time, we do not currently respond to DNT Signals.

We retain the categories of personal data set forth above in “What personal data may we collect about you?” section of this California Policy Notice only as long as is reasonably necessary for those purposes set forth above in “How we use your personal data and our legal basis” section of the Notice, except as may be required under applicable law, court order or government regulations.

With whom may we disclose your personal data?

We do not share (i.e., disclose to a third party for the purpose of cross-context behavioral advertising) or sell (as such terms are defined in the CCPA) any of the personal data we collect about you to third parties.

Within the last twelve (12) months, we have disclosed personal data collected through these interactions with us for a business purpose to the categories of third parties indicated in the chart below. We may also disclose your information to other parties as may be required by law or regulation, or in response to regulatory inquiries.

Your rights under the CCPA

Deletion Rights: You have the right to request that we delete any of your personal data that we retain, subject to certain exceptions, including, but not limited to, our compliance with U.S., state, local and non-U.S. laws, rules and regulations. We will notify you in writing if we cannot comply with a specific request and provide an explanation of the reasons.

Disclosure and Access Rights: You have the right to request that we disclose to you certain information regarding our collection, use, disclosure and sale of personal data specific to you. Such information includes:

  • the categories of personal data we collected about you;
  • the categories of sources from which the personal data is collected;
  • our business or commercial purpose for collecting such personal data;
  • the categories of third parties with whom we disclose the personal data;
  • the specific pieces of personal data we have collected about you; and
  • whether we disclosed your personal data to a third party, and, if so, the categories of personal data that each recipient obtained.

Correction Right: You have the right to request that we correct any inaccuracies in the personal data that we retain, subject to certain statutory exceptions, including, but not limited to, our compliance with U.S., state, local and non-U.S. laws, rules and regulations. We will notify you in writing if we cannot comply with a specific request and provide an explanation of the reasons.

No Discrimination: We will not discriminate against you for exercising your rights under the CCPA, including by denying service, suggesting that you will receive, or charging, different rates for services or suggesting that you will receive, or providing, a different level or quality of service to you.

How to Exercise Your Rights: To exercise any of your rights under the CCPA, or to access this notice in an alternative format, please submit a request on your behalf using any of the methods set forth in the Contact us section below.

We will contact you to confirm receipt of your request under the CCPA and request any additional information necessary to verify your request.  We verify requests by matching information provided in connection with your request to information contained in our records. Depending on the sensitivity of the request and the varying levels of risk in responding to such requests (for example, the risk of responding to fraudulent or malicious requests), we may request further information or your investor portal access credentials, if applicable, in order to verify your request.  You may designate an authorized agent to make a request under the CCPA on your behalf, provided that you provide a signed agreement verifying such authorized agent’s authority to make requests on your behalf, and we may verify such authorized person’s identity using the procedures above. If we request you verify your request and we do not receive your response, we will pause processing your request until such verification is received.
